Welcome to Duality Dynamics (Pty) Ltd (2023/937183/07), hereafter referred to as Duality Dynamics. By accessing or using our website www.duality-fitness.com, mobile applications, or any of our services, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully.
1. General
1.1 These Terms and Conditions govern your use of all services offered by Duality Dynamics (Pty) Ltd, including but not limited to:
- The Duality Fitness App
- FitMeals (online meal orders, delivery, and collection)
- Personal Coaching Services
- Wellness Workshops and Events
1.2 Duality Dynamics (Pty) Ltd reserves the right to amend these Terms and Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
1.3 If you do not agree with these Terms and Conditions, you must discontinue use of our services.
2. Duality Fitness App Subscriptions
2.1 All app subscriptions are non-refundable once access has been granted, unless required by law.
2.2 Subscriptions are billed according to the selected payment cycle (monthly, quarterly, semi-annual, or annual). Users are responsible for maintaining valid payment details.
2.3 The Duality Fitness App provides fitness, movement, and wellness content for general informational and educational purposes only. It does not replace medical advice. Users should consult a qualified healthcare professional before beginning any fitness or wellness program.
2.4 App access is for personal use only. Account sharing is prohibited and may result in suspension or termination without refund.
3. Personal Coaching & Wellness Services
3.1 Coaching services are delivered online via video call, except where explicitly stated (e.g. wellness coaching sessions conducted in person at Fit Café).
3.2 Coaching outcomes are not guaranteed. Results depend on individual effort, consistency, health status, and external factors.
3.3 Coaching sessions are to be scheduled in advance. Missed sessions without reasonable notice will be be forfeited, unless agreed otherwise with the account manager.
3.4 Out-of-package sessions are charged pro rata and do not include app access unless explicitly stated.
4. FitMeals (Meals, Delivery & Collection)
4.1 Freshness & Storage
Meals are freshly prepared and intended to be consumed within three (3) days from the date of production. This was tested when refrigerated between 3 and 5 degrees Celsius correctly. Duality Dynamics (Pty) Ltd is not liable for issues arising from improper storage or consumption beyond this period.
4.2 Delivery & Pickup
- Delivery is available only within a defined local radius and is subject to eligibility at checkout.
- Customers outside the delivery radius must collect meals at the specified location on the communicated date.
- Meals not collected or unsuccessfully delivered due to incorrect details are non-refundable.
4.3 Allergens
Meals are prepared in environments that handle common allergens. While care is taken, prevention of cross-contamination cannot be guaranteed. Customers with severe allergies must contact us prior to ordering, please.
4.4 Responsibility
Customers are responsible for verifying order details, delivery addresses, and dietary suitability before completing checkout.
5. Pricing & Payments
5.1 All prices are displayed in South African Rand (ZAR) unless otherwise stated.
5.2 Payments are processed securely via WooCommerce using Yoco. Duality Dynamics does not store card or banking details.
5.3 Duality Dynamics reserves the right to amend pricing at any time without affecting confirmed orders or active subscriptions.
6. Events, Workshops & Fit Café Activities
6.1 Event bookings are subject to availability and may require advance booking.
6.2 Cancellation and refund eligibility for events is governed by the Refund & Returns Policy, unless otherwise stated on the event page.
6.3 Participation in physical activities is voluntary and undertaken at the participant’s own risk.
7. Intellectual Property
7.1 All website content, app content, branding, videos, text, graphics, and materials are the intellectual property of Duality Dynamics (Pty) Ltd.
7.2 No content may be copied, reproduced, distributed, or used commercially without written permission.
8. Prohibited Use
You may not:
- Use our services for unlawful purposes
- Attempt to access restricted areas or systems
- Interfere with website or app functionality
- Misuse or resell services without authorisation
Violation may result in account suspension or termination.
9. Limitation of Liability
9.1 To the maximum extent permitted by law, Duality Dynamics (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages arising from use of our services.
9.2 All fitness, wellness, and nutrition-related services are used at the customer’s own discretion and risk.
9.3 Nothing in these Terms limits rights under the South African Consumer Protection Act 68 of 2008 where applicable.
10. Refunds & Cancellations
10.1 Refunds, cancellations, and exchanges are governed by our Refund & Returns Policy, which can be found on the Refunds & Returns Policy page.
11. User Accounts
11.1 Users are responsible for maintaining the confidentiality of login credentials.
11.2 Any misuse, sharing, or fraudulent activity may result in termination without refund.
11.3 Duality Dynamics upholds the standard information processing regulations as outlined in the Protection of Personal Information Act 4 of 2013.
12. Governing Law & Dispute Resolution
12.1 These Terms and Conditions are governed by the laws of South Africa.
12.2 Parties agree to attempt informal resolution through mediation before pursuing formal legal action.
